Terms & Conditions

These terms are an agreement between you and Avuno Technologies (Pty) Ltd (“we”, “us”, “myquack”), which operates the myquack marketplace at http://myquack.co.za. By creating an account or using myquack, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

1. What myquack is

myquack is an online marketplace that connects customers with independent service providers and lets them arrange and pay for an introductory booking securely. We provide the platform only. We are not the provider of the services listed, we are not a party to the agreement between a customer and a provider, and we do not employ providers. Providers are independent and responsible for the services they offer.

2. Eligibility & your account

  • You must be at least 18 and able to enter into a binding contract.
  • You must give accurate information and keep it up to date.
  • You are responsible for keeping your password safe and for activity under your account.
  • Providers and customers register under a fixed role; provider listings are subject to these terms.

3. Verification badges

Providers may choose to verify their business by uploading an official document, which is checked automatically. A “Verified” badge means a basic document check passed — it is not a guarantee, endorsement, or warranty by us of a provider’s identity, licensing, quality or conduct. Always use your own judgement.

4. Bookings, escrow & how payment works

  • When you book and pay for an introductory session, the amount is collected and held in escrow by our payment partner (Paystack).
  • Funds are released to the provider after the session is marked complete.
  • If a booking is cancelled in line with the cancellation rules below, the held amount is refunded to the customer.
  • You authorise us and our payment partner to collect, hold and disburse these amounts accordingly.

5. Fees & commission

myquack charges providers a commission on completed introductory bookings, together with a small escrow/processing fee. The applicable amounts are shown to you before you confirm a booking or payout. Payment-processing fees charged by our payment partner may also apply. We may change our fees on reasonable notice; changes do not affect bookings already confirmed.

6. Cancellations & refunds

A customer may cancel an unfulfilled, paid introductory booking, in which case the amount held in escrow is refunded. Once a session has been delivered and marked complete, it is not refundable through the platform except where required by law. Nothing here limits your rights under the Consumer Protection Act. Disputes about whether a service was delivered should first be raised with the other party, and then with us at support@myquack.co.za.

7. Provider obligations

  • Describe your services and pricing honestly and keep your listing accurate.
  • Hold any licences, registrations or qualifications required by law for your services.
  • Deliver services professionally, lawfully and with reasonable skill and care.
  • Provide correct payout details; you are responsible for the tax on your earnings.

8. Customer obligations

  • Give accurate booking information and pay amounts due.
  • Treat providers respectfully and attend booked sessions.

9. Reviews & content

Reviews must be honest and based on genuine experience. Do not post unlawful, defamatory, misleading or infringing content. You keep ownership of the content you submit but grant us a licence to host and display it to operate the service. We may remove content that breaches these terms.

10. Acceptable use

You agree not to:

  • arrange payment off-platform to avoid fees after connecting through myquack;
  • use the service unlawfully, fraudulently or to harm others;
  • scrape, copy or interfere with the platform, or attempt to breach its security;
  • impersonate anyone or misrepresent your business.

11. Intellectual property

myquack, its name, logo and software are owned by us and protected by law. We grant you a limited, non-exclusive right to use the service in line with these terms; all other rights are reserved.

12. Disclaimers

The platform is provided “as is”. We do not warrant that providers, listings or outcomes will meet your expectations, and to the extent permitted by law we exclude implied warranties. We are not responsible for the acts or omissions of providers or customers.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, and our total liability to you for any claim relating to the service is limited to the fees you paid to us in respect of the booking that gave rise to the claim. Nothing in these terms excludes liability that cannot be excluded under South African law, including under the Consumer Protection Act and the Electronic Communications and Transactions Act.

14. Indemnity

You agree to indemnify us against claims, losses and costs arising from your breach of these terms, your content, or the services you provide or receive through the platform.

15. Suspension & termination

You may stop using myquack at any time and deactivate or delete your account from your Account page. We may suspend or terminate access if you breach these terms or where necessary to protect users or comply with law. Terms that by their nature should survive (such as fees owed, IP and liability) continue after termination.

16. Governing law & disputes

These terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts. We will try to resolve any dispute with you informally first — please contact us at support@myquack.co.za.

17. Changes to these terms

We may update these terms from time to time. We will change the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use after a change means you accept the updated terms.
