- Consumer Protection Act 68 of 2008
- Electronic Communications and Transactions Act 25 of 2002
- Protection of Personal Information Act 4 of 2013
- Financial Intelligence Centre Act 38 of 2001 (through our escrow provider)
- Income Tax Act 58 of 1962 and the Tax Administration Act 28 of 2011
- Basic Conditions of Employment Act 75 of 1997, where applicable
6. How to request a record
- Complete the prescribed PAIA request form (Form 2 for a private body), available from inforegulator.org.za.
- Email it to privacy@myquack.co.za, or post it to the address in section 1.
- Give enough detail to identify the record and yourself, state the form of access you want, and provide contact details for our reply.
- If you are asking on behalf of someone else, attach proof of your authority.
- If the request is not for your own personal information, explain which right you are seeking to exercise or protect, and how the record would help.
We will respond within 30 days. That period may be extended by up to a further 30 days where the request covers a large number of records or requires a search of records held elsewhere; we will tell you in writing if that happens, and why.
7. When we may refuse
PAIA requires or allows us to refuse access in certain cases, including where the record:
- would unreasonably disclose someone else's personal information (section 63);
- contains a third party's commercial, financial or trade-secret information (sections 64–65);
- was supplied in confidence, or would breach a duty of confidence (section 65);
- would endanger someone's life or physical safety, or the security of property or a system (section 66);
- is privileged in legal proceedings (section 67);
- would harm our commercial or research interests (sections 68–69).
If we refuse, we will tell you in writing which ground applies and how to appeal or complain.
8. Fees
A request for your own personal information carries no request fee. For other requests, the prescribed request fee and any access fee (for searching, copying and delivery) apply as published by the Minister in the PAIA regulations. We will quote you before doing the work, and you may appeal the amount.
9. Your rights under POPIA
Separately from PAIA, POPIA gives you the right to ask what personal information we hold about you, to have it corrected or deleted, to object to how we use it, and to complain to the Information Regulator. How to exercise those rights is set out in our Privacy Policy. You do not need a PAIA form to ask us to correct or delete your own information — email privacy@myquack.co.za.
10. Complaints to the Regulator
If you are unhappy with how we handled your request, you may complain to the Information Regulator:
